Part 40: DOT-wide procedures

49 CFR Part 40 establishes procedures used across DOT-regulated drug-and-alcohol testing, including collections, laboratory and MRO processes, and return-to-duty requirements.

Part 382: FMCSA motor carriers

CDL employers subject to FMCSA drug-and-alcohol requirements generally work under Part 382 together with Part 40. Program duties include required testing categories, records, supervisor obligations, and Clearinghouse responsibilities where applicable.

Part 199: PHMSA pipeline operations

Part 199 applies to covered pipeline operators and contractors, together with Part 40 procedures. A trucking company does not use Part 199 merely because it carries hazardous materials; the regulated function matters.

Do not use a generic policy

Confirm covered employees and functions, testing authority, consortium/vendor roles, record custody, and escalation paths. The policy and actual workflow must match.
